Workmen's Compensation

Be careful when employing a person or company to do any type of repair or construction.

Although totally separate from the workmen's compensation issue, anyone you hire should have a business tax receipt (formerly called an occupational license) with the county.

In Florida, anyone involved in the construction industry must have workers' compensation insurance or an exemption.

Unfortunately for the small businesses and sole proprietorships, we are forced to abide by the law, even though we might not have other employees. As CEO, I have an approved exemption.

And to make matters worse, the Florida Statute definition for "construction industry" is...
"Construction industry" means for-profit activities involving any building, clearing, filling, excavation, or substantial improvement in the size or use of any structure or the appearance of any land.

See TITLE XXXI Chapter 440...

Therefore, make sure the person or company that you hire has workmen's comp or an exemption. To have an exemption, they must have a corporation or limited liability company. Unfortunately, some individuals advertise as a corporation or LLC when, in fact, their business is not registered with the state.

To search the state documents for corporations, and LLC's, see this link...
